What is a Homeowners' Association?
Despite all of the diversity of lifestyles, interests, ages,
and backgrounds, all townhome owners have at least one thing in common:
membership in a private, involuntary, usually nonprofit organization known as
the Homeowners Association. Because everyone owns the common areas, a sort of
mini-government must be created to maintain them to everyone's benefit. This is
the purpose of the Management Committee, which is responsible for the operation
of the community's common areas.
What does a Homeowners' Association do?
A homeowners' Association customarily does not hold title to
the property, but rather serves as the vehicle through which decisions affecting
the property are made. Some of the more important responsibilities of an
Association are: 1.) Providing for the repair and maintenance of the common
areas, 2.) Protecting the homeowners' shared investment, 3.) Establishing and
collecting assessments to pay for the common expenses of all owners, 4.)
Ensuring that adequate reserves are collected annually for future replacement of
major components of the property, 5.) Administering the rules and regulations of
the Association for the mutual benefit of all owners, and 6.) Creating a
positive living environment for all residents.
What does a Homeowners' Association do?
The manner in which the obligations of the Homeowner
Association are accomplished is set forth in a series of governing documents
known collectively as the Covenants, Conditions and Restrictions or CC&Rs for
short. The State of Utah requires the developer to file three basic documents:
1.) the Declaration, which establishes the Homeowners' Association, 2.) the
Bylaws for the Management Committee, which govern the Association's activities,
and 3.) the individual unit deeds of ownership. Before you purchase your home
your sales agent will provide you with a copy of the Covenants, Conditions and
Restrictions (CC&Rs) for the Brittany Homeowners Association. It is important
that you read and understand these documents before you purchase.

Included in association dues/fees are as follows: Clubhouse, Pool,
Basketball court, water, sewer, trash, basic cable, snow removal,
landscaping maintenance, insurance.

Special Assessments: There is a one time special assessment, due at closing
of $200.00.

2. LEGAL

There is no existing, pending or potential legal action of any type against
the HOA.

There is no restriction pending or potential, which may be acted upon by the
HOA.

The HOA is controlled by the board of directors.
