What is a condominium?
Utah State law defines
“condominium” as a form of real property ownership. The word condominium is actually a Latin term that combines the word
dominium, meaning ‘control’ (over a piece of property) with the word con, meaning ‘with’ (other individuals). When you buy a
condominium you receive a “bundle of rights.” That is, when title is transferred the buyer receives two things: exclusive ownership of
their specific home, and an undivided interest in the common areas of the project. Each specific home is typically the space from
the ceiling to the floor and within the walls of each unit. The common areas are those areas used by all owners such as walkways,
driveways, courtyards, swimming pools, clubhouses, and each building’s structural components.
What is
a Condominium Homeowners’ Association?
Despite all of the diversity
of lifestyles, interests, ages, and backgrounds, all condominium owners have at least one thing in common – membership in a private,
involuntary, usually nonprofit organization known as the condominium Association. Because everyone owns the common areas, a sort of
mini-government must be created to maintain them to everyone’s benefit. This is the purpose of the Management Committee, which is
responsible for the operation of the community’s common areas.
What
governs a Homeowners’ Association?
The manner in which the
obligations of the Homeowner Association are accomplished is set forth in a series of governing documents known collectively as the
Covenants, Conditions and Restrictions or CC&Rs for short. The State of Utah requires the developer to file three basic documents: 1.)
the Declaration, which establishes the Homeowners’ Association, 2.) the Bylaws for the Management Committee, which govern the
Association’s activities, and 3.) the individual unit deeds of ownership. Before you purchase your home your sales agent will provide you
with a copy of the Covenants, Conditions and Restrictions (CC&Rs) for the Brittany Homeowners Association. It is important that you read
and understand these documents before you purchase.
The following are some
frequently asked questions specifically about Brittany.
Q. What kind of
insurance should I purchase for my condominium? (click here) for more information
A. Each owner is responsible to purchase and maintain adequate liability and property insurance on
their own home and its contents. The Association carries a blanket policy for property and liability on only the common areas, not the
interior of your home. See page 3 of the CC&Rs for the definition of a unit.
Q. What cable
programs are included in my monthly fee? (click here) for a complete list
A. Each owner has basic cable service included in the monthly fee. If you would like to add
more channels, at your own expense, call Comcast at 485-0500 for more information.
Q. Can I have a pet? (click here) for more information
A. Each pet must be registered with the Management Company within 30 days. No more than 2 pets per home
are permitted. See Rules & Regulations for more information.
Q. Can we put up
a satellite T.V. dish? (click here) for request Form & Agreement
A. No aerials, antennas, satellite dishes or systems may be erected without the prior written
consent of the Management Committee. Check with the Management before you erect a satellite dish. See page 17 of the CC&Rs.
Q. Can I plant flowers around my home?
A. The Association shall maintain, repair and replace all landscaping throughout the common areas. Your patio
area may be decorated and maintained to your taste. Owners may plant annual type plants, but by doing so you become responsible for
weeding where you have planted. Also, keep in mind that the beds throughout the community are water with a drip system and it does
not provide adequate water for plants that were not originally installed. Owners who plant in the beds are responsible for all damage
caused to the sprinkler system.

Q. What are the
Clubhouse Hours and how do I get in?
A. The Clubhouse hours are from 7:00 A.M. to 10:00 P.M. seven days a week. A clubhouse key
fob
is required to access the clubhouse. You should have received the key
fob from the previous homeowner.
Q. Where can I store my R.V. or boat?
A. No recreational, commercial or vehicle may be stored on the property for a greater period of 2 days. See
page 17 of the CC&Rs.
Q. Who picks up the garbage?
A. Each owner will have their own garbage can. The
scheduled pick up date is on Monday
around 7:00 A.M. You may take your garbage out on Sunday evening, but you must store your garbage can in your garage at all other times.
The association will pay for each home to have one can, if you are in need of more than one can, contact Management at 955-5126 to order
another can. The price will be $10.00 per month.
Q. Can I hang a sign in my window?
A. No signs or banners shall be erected in the Common Areas or in a unit window for exterior display without
prior written consent of the Management Committee. See page 17 of the CC&Rs.
Q. My neighbor’s dog has made a mess in my front yard. Who is going to clean it up, and how do I stop it?
A. If your neighbor is in violation of the CC&R’s or the Rules and Regulations, you should make a written complaint
to the Management Committee care of Community Solutions & Sales. Your name will be held anonymous. The Management Committee
will enforce the CC&R’s and the Rules and Regulations.

if I notice an exterior maintenance problem? A. If you notice any common area repairs or maintenance that needs to be done, please call Community Solutions & Sales at 955-5126.

When are the
Board of Directors Meetings
The Board of Directors meet each
month to discuss the status of the Association as well as ongoing projects and community concerns.
If you have something you wish the
Board to address, please contact Management at 955-5126 to be added to the agenda.

Can the Clubhouse be
used for activities?
The clubhouse is available to reserve for
gatherings 7 days a week, 7am to 10pm Sunday thru Thursday, and Friday &
Saturday until 11pm.

A $60.00 rental fee is charged per day for the
use of the clubhouse rental room, with the following exception,
the fee is $30.00 for four hours or less (inclusive of setup & cleanup).
This rental fee is required at the time the clubhouse is reserved. Please
write separate checks for your rental fee and deposit.
